Levrault Case: Why the European Court of Human Rights rejected the magistrate’s request

The trial of the former Minister of Justice, Eric Dupond-Moretti, took place on November 6, 2023, before the Court of Justice of the Republic in Paris. This trial was prompted by a case involving a French investigating judge who had faced difficulties within the Monaco judicial system in 2019. The judge ultimately decided to bring his case to the European Court of Human Rights (ECHR). Edouard Levrault had been assigned to Monaco in 2016 for a three-year term, with the possibility of renewal for an additional term. However, his renewal was denied abruptly in June 2019 by the director of judicial services in Monaco, leading to political and diplomatic tensions.

Judge Levrault’s troubles began when he became involved in a case against Russian billionaire and AS Monaco president, Dmitri Rybolovlev, who was accused of corruption and influence trafficking. This led to the indictment of prominent individuals in Monaco, including the police chief, and sparked public protests by law enforcement officers. Despite interventions by French officials, Monaco asserted its sovereignty in handling the situation. Eventually, it was decided that Levrault would not be renewed for his term, and the director of judicial services in Monaco was also removed from his position.

The decision not to renew Levrault’s term sparked controversy among French magistrates and international organizations such as the Greco, which criticized the lack of judicial independence in Monaco’s legal system. The case took another twist when Levrault was later prosecuted by Eric Dupond-Moretti, who had succeeded him as Minister of Justice, for remarks made about Monaco on television. However, the Council of the Judiciary ultimately found no fault in Levrault’s actions, while Dupond-Moretti had to defend himself before the Court of Justice of the Republic. In November 2023, Dupond-Moretti was cleared of any wrongdoing in this case.

The events surrounding Judge Levrault’s tenure in Monaco highlight the challenges faced by foreign judges working within sovereign states with unique legal systems. The case also raises questions about the independence of the judiciary and the limits of political intervention in legal matters, both domestically and internationally. While the ECHR declined to comment on Monaco’s legal system, the implications of cases like Levrault’s resonate throughout the legal community and underscore the importance of protecting judicial independence. Ultimately, the resolution of this case demonstrates the complexities of navigating diplomatic and legal issues in the modern world.

The fallout from Levrault’s case serves as a cautionary tale for judges working in foreign jurisdictions and underscores the need for clear guidelines on the responsibilities and limitations of such roles. The involvement of high-profile individuals and political figures in the saga surrounding Levrault’s term raises broader concerns about the intersection of politics and the legal system. As the legal community reflects on this case, it becomes clear that ensuring the independence and integrity of the judiciary is essential for upholding the rule of law and protecting the rights of all individuals involved in legal proceedings.
