When Well-Intentioned Laws Turn Sour

Nicholas Bertram, CEO of Flashfood and Independent Director for PECO, brings a unique perspective to the issue of food waste, having spent over 20 years in the grocery industry. He highlights the excessive amount of food that is thrown away in North America, which could otherwise feed those who are hungry. This waste is often a result of the obsession with freshness indicators and the fear of consuming expired food, leading to an unnecessary amount of food being discarded.

Bertram also delves into the expiration of laws, using the example of the 18th amendment which implemented prohibition in the 1920s. He emphasizes the importance of reevaluating laws in relation to the current environment and information available, as some may no longer serve a purpose or make sense in today’s society. He calls upon legislative bodies to consider eliminating outdated laws before adding more statutes and policies to the already complex legal system.

Another example of a law that has outlived its usefulness is the creation of the Federal Trade Commission (FTC) in 1914, which aimed to regulate corporations and protect consumers. However, Bertram argues that the FTC has grown beyond its original purpose and is now hindering competition rather than fostering it. He questions the agency’s role in preventing mergers between companies like Kroger and Albertsons, which could benefit consumers and drive innovation in the grocery industry.

Bertram points out that Walmart, the largest grocer in the world, holds a significant market share in the United States, overshadowing competitors like Kroger and Albertsons. He believes that allowing the proposed merger between Kroger and Albertsons to proceed would create a stronger competitor to Walmart and other discount retailers, ultimately benefiting consumers. He calls for a reevaluation of the FTC’s role in regulating mergers and fostering competition in a global economy.

In light of the rapidly changing business landscape and the need for innovation, Bertram encourages business leaders to participate in the legislative process to ensure that laws remain relevant and support growth. He emphasizes the importance of strategic thinking and proactive engagement with policymakers to address outdated laws and regulations that may hinder progress. By advocating for a fresh approach to governance and business practices, Bertram aims to stimulate growth and transformation across industries.

Overall, Bertram’s insights shed light on the challenges of food waste, outdated laws, and regulatory barriers in the grocery industry.
