Ukrainian torture survivor takes legal action in Argentina against Russia

A Ukrainian man has filed a criminal complaint in Argentina’s Federal Judiciary against the Russian occupying forces who tortured him, as announced by The Reckoning Project (TRP), an international NGO that works to bring war crime cases to court. The man, identified as Mr M for security reasons, filed the torture complaint in Buenos Aires on April 15. This case represents the first time a Ukrainian torture complaint has been filed in Argentina, shedding light on the pain and suffering experienced by many in Ukraine. Argentina’s constitution allows for trials on international crimes, including crimes against humanity and war crimes, based on universal jurisdiction.

The man behind the complaint, Mr M, aims to bring Ukraine’s plight to the international stage, seeking justice for the countless victims of war crimes. Argentina has a history of addressing human rights abuses through trials, particularly in cases of crimes against humanity. The country was ruled by a military junta during the “Dirty War” from 1976 to 1983, where thousands were killed or went missing as a result of state-sponsored terrorism. The Prosecutor General’s Office in Ukraine has recorded over 128,000 victims of war crimes, highlighting the magnitude of the atrocities committed during the conflict.

Ukraine has been gathering pretrial information on the numerous victims of war crimes, showcasing the extent of the human rights violations that have occurred. The filing of the torture complaint in Argentina signifies a step towards seeking accountability for these crimes and holding the perpetrators responsible. Nataliya Gumenyuk, a Ukrainian journalist and CEO of the Public Interest Journalism Lab, accompanied the survivor to Argentina for the filing of the complaint, emphasizing the importance of upholding the rule of law and seeking justice through international support.

According to Reuters, the Russian forces held Mr M in a detention center in Ukraine’s occupied south, where he was subjected to electrocution and unlawful imprisonment as forms of torture in mid to late 2022. The complaint names specific individuals responsible for the torture, as well as others involved in the crimes. The court in Argentina will now determine whether to accept the complaint, a process that could take several months. This legal action represents a significant move towards seeking justice for the victims of war crimes in Ukraine and holding the perpetrators accountable for their actions.

The international community plays a crucial role in supporting independent journalism and advocating for human rights around the world.
