The Supreme Court rejects two complaints against Minister Montero for not revealing Ayuso’s partner’s secret information.

The Supreme Court has flatly rejected the complaint filed by two associations (Liberum Association and Freedom and Alternative Forum Foundation) against the Minister of Finance, the socialist María Jesús Montero, whom they accused of disclosing personal data of Isabel Díaz Ayuso’s partner, Alberto González Amador, who was charged with tax fraud. The two associations attributed to Montero a crime of disclosure of secrets and unfaithfulness in the custody of documents for public statements she made on March 12, but the court maintains that the minister did not disclose “any personal and confidential data” of the president of Madrid’s partner. The dismissal order was unanimously issued by a tribunal composed of the judges Manuel Marchena (president), Juan Ramón Berdugo, Antonio del Moral, Susana Polo, and Carmen Lamela (rapporteur). What Montero said in March was the following: “I would say, first of all, that it obviously requires that the president of the Community of Madrid gives explanations and acts with absolute transparency regarding whether, indeed, as reported in the media, she is living in an apartment that was paid for with fraud to the public treasury and that was paid for with commissions regarding masks in the worst situation of the pandemic that this country had…”. The second vice president of the Government made these statements hours after it was known that González Amador was being investigated by the Public Prosecutor’s Office for tax fraud. According to the two plaintiff associations, Montero’s statements implied that the minister accessed and seized personal and confidential data related to the president of the Community of Madrid’s partner without authorization, which were in public files or records; she used that data publicly for political purposes and with knowledge of its illicit origin; and that the access to the personal data occurred “taking advantage” of her position as Minister of Finance. The court denies that there is data to deduce that and therefore dismisses the complaints.
