The Bruce Lehrmann defamation trial showcases the dangers and costly consequences of taking big risks

The case involving an alleged rape by a man named Lehrmann, reported by Channel Ten, was dropped after a jury member was discovered to have broken the rules. Lehrmann denies the accusations and maintains his innocence. However, this makes it harder for Ten’s lawyers to convince Federal Court Justice Michael Lee of the crime’s occurrence. The standard of proof is higher in such cases, requiring the judge to be “reasonably satisfied” of what happened. If Justice Lee is not convinced by Ten’s lawyers, Lehrmann will have won a significant round. Justice Lee has expressed doubts about the credibility of both Lehrmann and Higgins, the alleged victim’s, evidence. He mentioned that various parts of each witness’s testimony cannot be accepted.

Higgins claims she was severely intoxicated when Lehrmann assaulted her, while Lehrmann states he did some work before leaving without checking on his colleague in the next room. Justice Lee may be convinced that Lehrmann entered the room but find insufficient evidence to establish what occurred inside. Even if Lehrmann were to win the case, an unproven allegation of rape could still damage his reputation. Additionally, legal costs could financially ruin him if he loses or if the court orders him to pay costs despite winning a small damages payment. A previous defamation case saw Justice Lee award token damages to plaintiffs to discourage wasteful court proceedings.

As Justice Lee was about to deliver his judgement, a new witness came forward, leading to the case being reopened. Allegations emerged that Lehrmann was provided with benefits in exchange for participating in a Channel Seven interview. It is expected that Justice Lee will thoroughly examine relevant statutes and precedents to issue a well-founded judgement. The case invokes parallels with Leon Uris’ novel QB V11, which details a defamation case involving a Jewish doctor from Auschwitz. The doctor was awarded minimal damages due to his severely tarnished reputation. This may serve as a cautionary tale for individuals involved in such high-profile legal battles.

The legal proceedings in Lehrmann’s case have been marked by credibility issues, unproven allegations, bombshell revelations, and outrageous claims. Justice Lee is expected to deliver his judgement shortly, marking the end of a legal saga filled with drama.
