A man in Çorum filed for divorce from his wife, claiming that she did not show him or their children any attention, neglected household chores, isolated herself in social situations, did not attend weddings or funerals, and insulted and physically abused her parents. He also requested compensation. In response, the woman filed a counter lawsuit, alleging that her husband had subjected her to psychological and physical abuse, ignored her, neglected their problems with various excuses, and used the pretext of debts to take gold coins she had saved for their children. She also sought financial and moral compensation.
The Çorum 2nd Family Court found the woman to be heavily at fault in light of the claims made in the divorce case and ruled for the couple to divorce, rejecting the woman’s compensation claim and ordering her to pay 10,000 Turkish Liras in compensation to the man.
After the local court’s decision was appealed, the Samsun Regional Court of Justice 4th Civil Chamber reviewed the case and determined that the man’s physical abuse against the woman made both parties equally at fault. Therefore, the requests for compensation were mutually rejected.
The appeal court listed the woman’s actions considered as faults, including “leaving the man alone on special days and family visits, not attending family funerals and offering condolences, insulting the man’s mother, physical abuse, and eviction from the house.” The man’s faults were stated as “being indifferent, taking the children and leaving the woman alone to visit his family on weekends, not spending enough time with the woman, and violence.”
Upon further appeal, the 2nd Civil Chamber of the Court of Cassation upheld the appeal court’s decision as compliant with the Law on Civil Procedure No. 6100.
