Illinois Supreme Court to Review Jussie Smollett’s Appeal of Conviction for Faking Racist Attack

The Illinois Supreme Court has agreed to hear an appeal from actor Jussie Smollett regarding his disorderly conduct conviction for staging a racist and homophobic attack against himself in 2019. Smollett, known for his role in the television drama “Empire,” was convicted by a Cook County jury in 2021. The appeal comes after a state appellate court upheld the conviction in December. The case gained international attention and led to an intense investigation by Chicago police. There is no set date for the high court to hear arguments on the matter, but a special prosecutor refiled charges against Smollett after the original case was dropped by the Cook County State’s Attorney Kim Foxx.

In a 2-1 decision, the state’s First District Appellate Court dismissed Smollett’s claims that the case should not have been refiled, stating that there was no promise made to him regarding facing a fresh prosecution. Justice Freddrenna Lyle dissented from the decision, calling the refiled charges “fundamentally unfair.” Smollett’s legal team has argued that he has been victimized by a racist and politicized justice system due to his race and sexual orientation. The actor was found guilty of five counts of disorderly conduct for orchestrating the attack and lying to police about it, claiming two men assaulted him with racist slurs and references to former President Donald Trump’s slogan.

During the trial, testimony revealed that Smollett had paid $3,500 to two men from the “Empire” cast to carry out the attack. Despite this evidence, Smollett took the stand and maintained that there was no hoax involved. He was ultimately sentenced to 150 days in jail, six of which he served before being released pending appeal, as well as 30 months of probation and ordered to pay $130,160 in restitution. The legal battle surrounding this case has been ongoing, with Smollett’s attorneys continuing to argue his innocence. The outcome of the appeal before the Illinois Supreme Court could have significant implications for the actor’s future.

The Jussie Smollett case has been a highly publicized and controversial legal saga, garnering attention from media outlets and the public alike.
