Former President Trump’s social media posts about judge’s daughter prompt expansion of gag order by judge.

Former President Donald Trump faced an expanded gag order in his hush-money trial, banning him from making public statements about the judge’s family after he targeted a Democratic political consultant on social media. The judge, Juan M. Merchan, warned of potential consequences, including being held in contempt of court, fines, or even jail time for violating the order. Trump’s lawyer and the district attorney’s office declined to comment on the revised gag order.

The hush-money case against Trump involves allegations of falsely logging payments to his former lawyer, Michael Cohen, as legal fees to cover up negative stories about Trump during the 2016 campaign. Trump is accused of paying $130,000 to porn actor Stormy Daniels to keep quiet about a sexual encounter. Trump pleaded not guilty to charges of falsifying business records and denies any wrongdoing. The case has sparked controversy, with Trump making unfounded claims on social media about the judge, his family, and the prosecutor.

Trump’s posts on Truth Social accusing the judge of bias due to his daughter’s political consulting work led to the expanded gag order. The judge admonished Trump for targeting family members of presiding jurists and attorneys, creating fear among participants in the trial. Prosecutors requested clarification of the order, urging Trump to cease attacks on family members. Trump’s lawyers raised constitutional concerns about restricting his speech while campaigning for president and fighting criminal charges.

Despite Trump’s efforts to challenge the gag order and push for the judge’s recusal from the case, Merchan stood firm. The judge had previously rejected calls for recusal based on allegations of bias related to his daughter’s work and political donations. The expanded gag order now prohibits Trump from commenting on the judge’s family and the prosecutor’s family, in addition to earlier restrictions on statements about jurors and potential witnesses.

Merchan warned Trump that he would forfeit his right to see the names of jurors if his conduct threatens their safety or integrity. The judge emphasized the need to prioritize the safety and well-being of all participants in the trial, including jurors and witnesses. The ongoing legal battle between Trump and the court highlights the complexities of balancing free speech rights with the integrity of the judicial process.

As the trial continues, Trump’s actions and statements will be closely monitored to ensure compliance with the gag order. The case raises questions about the limitations of free speech in legal proceedings involving high-profile individuals and the potential consequences for violating court orders. Despite the challenges posed by Trump’s rhetoric, the judge remains steadfast in upholding the rule of law and protecting the fairness of the trial.
