Court proceedings follow emergency involving asbestos in mulch

A well-known property developer and owner of the Max Brenner chocolate cafe chain in Sydney is facing charges brought by the NSW Environment Protection Authority in relation to the asbestos-in-mulch emergency that occurred at the start of the year. Arnold Vitocco, the director of VE Resource Recovery, which operates the Greenlife Resource Recovery Facility in Bringelly, has been charged with an executive liability offence. The investigation found that most of the contaminated mulch detected in Sydney earlier this year originated from the Greenlife site. Two entities trading as Greenlife Resource Recovery Facility, Freescale Trading Pty Ltd and Runkorp Pty Ltd, are also facing charges for reusing asbestos waste, breaching a resource recovery order, and carrying out scheduled activities without a licence.

The fines for illegal dumping in NSW range from $7500 to $1 million for individuals, and $15,000 to $5 million for corporations, with the possibility of imprisonment. The contamination of asbestos in mulch spread rapidly across Sydney after it was discovered in landscaping mulch used to beautify parkland above the new Rozelle Interchange in January. The EPA began checking other sites, and a task force was appointed by the government to oversee the investigation of asbestos-contaminated green spaces. While most of the asbestos found was bonded and not easily inhaled, causing minimal health risks, many parks, schools, hospitals, and playgrounds were closed as a precaution. Events, like the Mardi Gras Fair Day, were canceled, impacting communities and residents.

During the investigation, over 300 sites were inspected, with 79 sites identified as having used contaminated mulch. The discoveries sparked widespread concern about the potential health risks of exposure to asbestos, particularly in public spaces where people of all ages frequent. The NSW Land and Environment Court has scheduled a directions hearing for February 7 to address the charges brought against Arnold Vitocco and the entities associated with the Greenlife Resource Recovery Facility. As the largest investigation undertaken by the NSW EPA, the case highlights the importance of proper waste management and environmental protection in safeguarding public health and the environment.

The charges against Arnold Vitocco and the other entities shed light on the serious consequences of illegal waste disposal practices and the risks they pose to the community. The situation also underscores the need for strict regulatory enforcement and compliance measures to prevent similar incidents from occurring in the future.
