The resolution introduced by Congressional Democrats aims to ensure that U.S. emergency rooms provide emergency abortions when a woman’s health or life is at risk, despite strict state abortion bans. This comes in response to a report by The Associated Press which found that over 100 pregnant women have been denied care since 2022. Rep. Mikie Sherrill, a Democrat from New Jersey, called the findings an outrage and emphasized the importance of treating pregnant women in emergencies. The resolution, however, faces challenges in a Republican-controlled House in an election year. Senator Patty Murray of Washington has also announced plans to introduce a Senate version of the resolution.
Federal law requires that patients who arrive at emergency rooms receive stabilizing treatment for medical emergencies. However, the overturning of the national right to abortion by the U.S. Supreme Court and the implementation of strict abortion bans by states have led to confusion and conflict in emergency rooms, particularly in states like Texas, Idaho, and Florida. Pregnant women in need of care for conditions such as preterm rupture of membranes or dangerous ectopic pregnancies have been turned away or left untreated, sometimes resulting in tragic outcomes.
Earlier this year, the U.S. Supreme Court had the opportunity to address the issue of emergency abortions in the context of federal law but did not provide a clear ruling. Instead, the conservative majority court issued a narrow order allowing doctors in Idaho to perform emergency abortions temporarily, despite state restrictions, and sent the case back to lower courts for further consideration. In Texas, a legal battle is ongoing as the state challenges the Biden administration’s guidance that emergency rooms must provide abortions in cases where a woman’s health or life is at risk, potentially leading to another Supreme Court case.
The AP’s investigation revealed instances of pregnant women being denied care in emergency rooms across the country, including states like California and Washington that do not have abortion bans. The number of complaints increased significantly in states like Texas following the overturning of Roe v. Wade in 2022. One such case involved a Black woman in Ohio who was charged with a felony after miscarrying at home because doctors would not terminate her non-viable pregnancy due to state abortion laws at the time. Rep. Emilia Sykes of Ohio introduced the resolution in response to this incident, emphasizing the importance of ensuring access to reproductive health care, especially in life-threatening situations.
Despite the potential obstacles in passing the resolution, Democratic lawmakers are determined to address the issue of emergency abortions in U.S. emergency rooms. The ongoing legal battles and conflicts surrounding state abortion bans and federal law have raised concerns about the treatment of pregnant women in critical situations.
