An appeals court in Texas recently ruled in favor of attorney Sidney Powell, upholding a state court judge’s decision to dismiss an attorney discipline petition against her related to her involvement in former President Donald Trump’s efforts to reverse the 2020 election results. While several others who assisted Trump in his election reversal attempts faced professional misconduct allegations, Powell has managed to avoid similar disciplinary actions in Texas. However, she did plead guilty in a criminal case brought against her by the Fulton County district attorney in Georgia for election subversion plots.
The Texas appeals court ruled that the Texas Bar’s Commission for Lawyer Discipline was unable to prove that Powell engaged in “dishonesty, fraud, deceit, or misrepresentation” in the lawsuits she filed challenging Trump’s loss. Despite being licensed in Texas, the commission failed to show that Powell violated the professional code for attorneys in the state. The appeals court expressed concerns over the commission’s interpretation of “dishonesty” and noted that dishonesty involves a conscious perversion of the truth.
A spokesperson for the disciplinary commission did not comment on the ruling and mentioned that they are still deciding on their next steps, including possibly appealing the decision to the state Supreme Court. Powell’s attorney in the disciplinary matter, Bob Holmes, affirmed that the trial court followed the law and that the appellate court upheld the judgment. While Powell was successful in avoiding disciplinary action in Texas, she has not been able to contest sanctions imposed by a federal court for filing frivolous lawsuits challenging the election results in Michigan.
