Antitrust probes to be opened into Nvidia, Microsoft, and OpenAI by U.S. regulators

The Federal Trade Commission and the Justice Department are launching antitrust investigations into Microsoft, OpenAI, and Nvidia to examine the extent of their influence on the artificial intelligence industry. The FTC will focus on Microsoft and OpenAI, while the DOJ will investigate Nvidia. Rather than looking into mergers and acquisitions, the investigations will examine the companies’ conduct in the market. This news came after a group of current and former OpenAI employees published an open letter expressing concerns about the lack of oversight and whistleblower protections in the AI industry.

As startups like OpenAI and Anthropic gain momentum in the generative AI market with products like the ChatGPT and Claude chatbots, tech giants including Google, Microsoft, Amazon, and Meta have been engaged in an AI arms race. These companies are investing heavily in AI technology to ensure they remain competitive in a market expected to exceed $1 trillion in revenue within a decade. For example, Microsoft initially invested $1 billion in OpenAI in 2019, which has since grown to about $13 billion. Companies like Microsoft heavily rely on OpenAI’s models for products like the Copilot chatbot and offer open-source models on the Azure cloud platform.

Significant investments in AI models are necessary due to the high cost of building and training them, which requires thousands of specialized chips that, until now, have mainly come from Nvidia. Meta, for example, is spending billions on Nvidia’s graphics processing units as it develops its own AI model called Llama. Nvidia’s revenue has seen substantial growth, boosted by companies like Meta investing in its chips. The investigations into these companies come as concerns grow over the rapid advancement of AI technology and the lack of oversight and whistleblower protections in place to regulate the industry.

The news of the impending antitrust investigations follows the FTC’s decision in January to conduct a comprehensive study of AI industry heavyweights, including Amazon, Alphabet, Microsoft, Anthropic, and OpenAI. FTC Chair Lina Khan announced the inquiry during the agency’s tech summit on AI, describing it as a market inquiry into the investments and partnerships between AI developers and major cloud service providers. The agency will invoke its authority under Section 6(b) of the FTC Act to conduct the study separately from its law enforcement arm, allowing it to make civil investigative demands on companies to provide specific reports and answer questions about their businesses.

Overall, the antitrust investigations into Microsoft, OpenAI, and Nvidia are part of a broader effort to ensure fair competition in the rapidly evolving artificial intelligence industry. With the potential for significant revenue growth in AI technology and concerns over the lack of oversight in the industry, regulators are looking to examine the conduct of these powerful companies to ensure they are not engaging in anticompetitive practices. The investigations come at a time when the AI industry is experiencing rapid advancements and concerns over the ethical implications of unchecked technological development.
