Alec Baldwin was involved in a fatal shooting incident on the set of the film “Rust” which led to the death of cinematographer Halyna Hutchins in 2021. State District Court Judge Mary Marlowe Sommer dismissed the involuntary manslaughter charge against Baldwin midway through the trial due to the withholding of crucial evidence by police and prosecutors. The dismissal was made with prejudice, meaning that it cannot be refiled once all appeals have been exhausted. Special prosecutor Kari Morrissey later requested the judge to reconsider the decision, arguing that there were insufficient facts and that Baldwin’s due process rights were violated.
During the rehearsal for the film, Baldwin was pointing a gun at Hutchins when it accidentally discharged, killing her and wounding director Joel Souza. Baldwin stated that he had pulled back the hammer but not the trigger, and the gun fired. Evidence that ultimately led to the dismissal of the case was live ammunition that was brought to the sheriff’s office by a man who claimed it might be connected to the shooting. Prosecutors deemed the ammunition irrelevant, but Baldwin’s legal team accused them of hiding the evidence, which ultimately led to the successful dismissal of the case.
Judge Marlowe Sommer called the discovery violations and misconduct committed by law enforcement and prosecutors “egregious” in her decision to dismiss the case against Baldwin. The defense argued that the state deliberately withheld evidence requested by Baldwin, preventing him from pursuing the truth during the trial. The prosecutors attempted to link the live ammo found on the set to armorer Hannah Gutierrez-Reed to show Baldwin should have recognized her inexperience and youth. Gutierrez-Reed is currently serving an 18-month sentence for involuntary manslaughter due to safety protocol violations and failing to identify live ammunition on set. Assistant director David Halls also pleaded no contest to negligent use of a deadly weapon and received a probation sentence.
