Alabama’s election chief warns that Biden may not meet November ballot deadline

Alabama Secretary of State Wes Allen, a Republican, has raised concerns that President Joe Biden could be left off the ballot in Alabama for the 2024 general election due to the state’s certification deadline falling before the Democratic Party’s convention. The deadline is set for August 15, four days before the convention is scheduled to begin. Unless the Democratic Party submits a valid certificate of nomination by the deadline, Biden’s name will not appear on the ballot. This issue was also raised in Ohio, where a similar concern was raised about Biden being left off the ballot.

Alabama Democratic Party Chairman Randy Kelley has contacted the Democratic National Committee (DNC) to address this issue and explore possible solutions. One option could be for the party to submit a provisional certification to ensure Biden’s name is included on the ballot in Alabama. The Biden campaign has expressed confidence that the president will be on the ballot in all 50 states, stating that state officials have the ability to grant provisional ballot access certification ahead of the conclusion of presidential nominating conventions.

Alabama law requires the names of presidential nominees to be submitted 82 days before the election, adding further complications to the situation. In 2020, the Republican-controlled Alabama Legislature passed legislation to change the certification deadline for that year’s election to accommodate the Republican National Convention. The deadline was moved forward by about a week for that specific year. Currently, the situation remains unresolved, with the uncertainty of whether Biden will be included on the Alabama ballot for the 2024 general election.

The Biden campaign’s statement highlights the importance of state officials having the authority to grant provisional certification for nominees before the conclusion of nominating conventions. It references several states that allowed provisional certification for Democratic and Republican nominees in the 2020 election, including Alabama. While the law in Alabama is strict about the deadline for submitting nominee names, there is potential for the DNC and Alabama Democratic Party to work towards addressing this situation to ensure Biden’s name appears on the ballot.

The issue of President Biden potentially being left off the ballot in Alabama underscores the complexities surrounding election laws and deadlines. With multiple states having different certification deadlines and requirements, it becomes crucial for political parties to navigate these obstacles to ensure their candidates are eligible to run in elections.
