Appeals Court in New York Reverses Harvey Weinstein’s Rape Conviction from 2020

Harvey Weinstein’s rape conviction from 2020 was overturned by the New York State Court of Appeals on the basis of judge prejudice and improper rulings. The court found that allowing testimony of uncharged prior sexual acts against individuals not related to the case was erroneous and warranted a new trial. The majority of the court claimed an abuse of judicial discretion in permitting these allegations as they did not shed light on Weinstein’s credibility in relation to the criminal charges.

Judge Madeline Singas criticized the majority’s decision, accusing them of whitewashing the facts to align with a he-said/she-said narrative and overturning juries’ guilty verdicts in cases of sexual violence. Attorney Douglas H. Wigdon, who represented eight of Weinstein’s victims, expressed disappointment in the decision, stating that allowing evidence of uncharged acts can provide insight into the defendant’s intent or modus operandi. The reversal of the verdict means that the victims will have to endure another trial, which is seen as a setback in holding individuals accountable for acts of sexual violence.

Weinstein is currently serving a 23-year sentence in a New York prison for charges of criminal sex act and rape, while being acquitted on a predatory sexual assault count. He remains steadfast in his claim of innocence, insisting that the encounters were consensual. Despite the overturned conviction, Weinstein will continue to be imprisoned due to a separate conviction in Los Angeles in 2022 on rape charges. He was acquitted on charges involving one of the women who testified in New York.

Weinstein’s accuser in the New York case testified that she felt humiliated and miserable after the encounter, stating that she wished it never happened. The accuser alleged that Weinstein forced her into a demeaning situation and that she did not fight back. Following multiple accusations of sexual misconduct in 2017 as part of the #MeToo Movement, Weinstein’s ex-wife, Georgina Chapman, ended their marriage of nearly 10 years. Chapman cited the expanding stories of misconduct as the reason for her decision to leave and protect her children.
