Arizona Democrats ready to push forward with repeal of 1864 abortion ban

Democratic state Rep. Stephanie Stahl Hamilton expressed her uncertainty about the Democratic effort in the Arizona State Legislature to repeal an 1864 abortion ban before it goes into effect. She emphasized the need to keep trying and continue all efforts to repeal the ban, as it would have significant implications for the people of Arizona. The Arizona Supreme Court recently ruled that the 160-year-old law can be enforced, only allowing abortions in cases where the life of the mother is at risk, thus prohibiting the procedure in all other cases.

Despite two previous failed attempts by Democrats to repeal the ban, they are persisting in their efforts to challenge Republican House Speaker Ben Toma and gather enough support for a vote on a rules change. An April 17 attempt to repeal the ban through a temporary rule change fell short by one vote, but progress was made in the Senate with two Senate Republicans supporting a repeal bill. However, two more readings are required before the bill can be brought to a vote. Toma has been critical of the Democrats’ approach to abortion and emphasized the need for careful consideration and discussion on such a significant topic.

Arizona Senate Democrats are doubtful about the future of any repeal efforts moving forward in the House, expressing concerns about Republican support and potential changes in opinions at the last minute. Democratic state Sen. Eva Burch highlighted the fracture within the Republican caucus in Arizona and their inability to agree on addressing the Civil War era abortion ban going into effect. Despite these challenges, some Democrats, such as state Sen. Anna Hernandez, remain hopeful that anything can happen regarding a repeal effort, though confidence in a successful outcome is lacking.

The legislature is scheduled to meet again to address the issue of the 1864 abortion ban, with Arizona Right to Life, an anti-abortion group, calling on legislators to oppose any repeal efforts and planning to organize at the state capitol as well. The contentious battle over abortion in Arizona highlights the complexities and challenges surrounding reproductive rights and access to healthcare. The outcome of the ongoing legislative efforts to repeal the ban remains uncertain, with divisions within the Republican caucus and skepticism from Democrats further complicating the situation. The political landscape surrounding abortion laws in Arizona continues to be a focal point of debate and advocacy on both sides of the issue.
