Ana Messuti, lawyer for the Argentine lawsuit against Francoism, dies

Ana Messuti, a lawyer for the Argentine lawsuit that promotes the investigation of crimes during the Franco regime, has passed away in Madrid due to an illness. Emilio Silva, the president of the Association for the Recovery of Historical Memory, confirmed her death, stating that she had been battling cancer. Silva highlighted Messuti’s work over the years, noting that she had been a beacon of hope for victims of the Franco regime who had nowhere else to turn. He praised her dedication to pursuing justice for the victims and ensuring that their stories were heard.

The Argentine lawsuit, which began in 2010, was initiated by various groups and families of victims of the Spanish Civil War and the Franco dictatorship. It aimed to investigate alleged crimes against humanity committed during that period. Messuti was one of the lawyers who successfully pushed for former Spanish minister Rodolfo Martín Villa to be prosecuted in Argentina for his role in the deaths of several individuals between 1976 and 1978. In September 2021, the Argentine judge María Servini rejected Martín Villa’s request to have the case dismissed, stating that the crimes could amount to crimes against humanity and were therefore not subject to statute of limitations.

Messuti also played a crucial role in facilitating the return of the identified remains of 22 individuals who were killed during the Franco repression, including Timoteo Mendieta, whose remains were exhumed from the cemetery in Guadalajara. Her dedication to uncovering the truth and seeking justice for the victims of the Franco regime was unwavering. Her work not only shed light on the atrocities committed during that time but also provided closure to the families of the victims who had long been seeking answers.

Emilio Silva described Messuti as a great lawyer and a philosopher of law. He emphasized her immense generosity and intelligence, stating that she had done more for the victims of the Franco dictatorship than the entire state had done. The Association for the Recovery of Historical Memory expressed their gratitude for her tireless efforts and vowed to never forget her. Messuti’s legacy will continue to inspire future generations to fight for justice and remembrance of the victims of oppressive regimes.

The passing of Ana Messuti is a great loss not only to the legal community but also to the pursuit of historical justice.
