Trump’s appeal of gag order in New York “hush money” case denied

The appeals court has upheld a gag order placed on former President Donald Trump before his criminal trial in New York, stating that it will remain in place until his sentencing in September. Despite Trump’s objections to the order, which prohibits him from publicly commenting on prosecutors, court staff, and their families, as well as witnesses and jurors, the court has determined that it should remain in effect. Trump has been critical of Manhattan District Attorney Alvin Bragg and Justice Juan Merchan, the judge presiding over the case, but the gag order restricts his ability to make such comments.

Trump’s challenge to the gag order comes after being unanimously convicted on 34 felony counts of falsifying business records. His lawyers argued that the gag order should have been lifted after the trial ended, but the appellate court disagreed. They stated that the fair administration of justice includes the sentencing phase, and therefore, the gag order will remain until Trump is sentenced. A spokesperson for Trump’s campaign criticized the gag order as “blatantly un-American,” while indicating that Trump continues to challenge the court’s decision to maintain it.

Originally scheduled to be sentenced on July 11, Trump’s sentencing date was postponed after he filed a motion to set aside his conviction based on a recent U.S. Supreme Court decision related to presidential immunity. Judge Merchan has stated that he will issue a decision on Trump’s motion on September 6 and, if he rejects it, will proceed with sentencing on September 18. Trump’s ongoing legal battles and challenges to the court’s decisions have kept the case in the spotlight, with tensions high between the former president and the legal system.

The ongoing investigations and legal proceedings involving Trump have attracted significant media attention and public interest. As an investigative reporter covering criminal justice, privacy issues, and information security for CBS News Digital, Graham Kates has been closely following the developments in Trump’s case. The appeals court’s decision to uphold the gag order adds another layer of complexity to the case and highlights the ongoing legal battles between Trump and the justice system. With the sentencing date approaching in September, the outcome of Trump’s criminal trial in New York remains uncertain.

Despite Trump’s attempts to challenge the gag order and other legal decisions, the courts have consistently upheld their rulings throughout the trial. The restrictions placed on Trump’s ability to comment on the case and its participants are meant to ensure a fair and impartial judicial process. As the former president faces the prospect of sentencing in September, the focus remains on the legal proceedings and the implications of the criminal charges against him. The outcome of Trump’s case will have far-reaching consequences and will continue to be closely monitored by the media and the public.
