Civil rights organizations file lawsuit against Iowa law permitting police to detain and remove certain migrants

A lawsuit has been filed against Iowa’s new law that makes it a crime to be in the state if previously denied admission to the U.S. The lawsuit alleges that the law violates the federal government’s authority to enforce immigration law. This is the first legal action taken against Iowa in response to the law, despite the U.S. Department of Justice warning the state that they would sue if the law was enforced. The American Civil Liberties Union of Iowa and the American Immigration Council filed the suit on behalf of the Iowa Migrant Movement for Justice and two individual Iowans.

The Iowa law has caused fear among immigrant communities in the state, with concerns about racial and ethnic profiling, interactions with police, and reporting crimes. Activist and advocacy groups have been hosting gatherings to answer questions and organizing protests in response to the new law. The law would make it a crime to be in the state if previously denied admission to the U.S., and is set to go into effect on July 1. The Texas law which had similar provisions was briefly enforced before being put on hold by a federal appeals court’s three-judge panel.

Law enforcement officials and legal experts have raised questions about how the laws in Iowa and Texas would be implemented, as immigration law enforcement has traditionally been the responsibility of the federal government. The Iowa law would allow criminal charges to be brought against individuals with outstanding deportation orders or who have previously been removed from the U.S. Once in custody, migrants could either agree to leave the U.S. or face prosecution. Republican leaders in Iowa and across the country have criticized Democratic President Joe Biden for his handling of the influx of migrants at the U.S.-Mexico border.

The state of Iowa has vowed not to back down in response to the lawsuit challenging the constitutionality of the new immigration law. The Texas law, which had similar provisions, is currently being reviewed by a federal appeals court. The Iowa law has raised concerns about the potential for racial profiling and complications in interactions with law enforcement. Activist groups have been working to educate communities and address fears stemming from the new legislation. Despite criticisms from Republican leaders, the lawsuit and opposition to the law highlight ongoing debates and legal challenges surrounding immigration enforcement in the United States.
