10-year-old Texas boy confesses to killing man in 2022, but cannot be charged according to state law

A 10-year-old boy in Texas has confessed to a murder that occurred over two years ago, but due to state law, he cannot be charged with the crime. The boy shared information that had not been made public regarding the slaying of Brandon O’Quinn Rasberry, who was found dead in his RV with a gunshot wound to his head. Rasberry had only been living in the RV park for four days before his body was discovered by authorities. Despite exhausting all leads in the case over the past two years, the boy’s confession provided a breakthrough in the investigation.

Investigators believe that Rasberry had been dead for two days before he was reported missing by his employer. The police, after interviewing neighbors and examining Rasberry’s cell phone data, had run out of leads until the 10-year-old boy’s shocking confession. The boy’s school principal contacted the authorities after the boy made threats to kill another student, prompting the investigation to focus on the boy’s potential involvement in the murder of Rasberry.

The child recounted in detail his actions on the night of the murder, stating that he obtained a 9mm pistol from his grandfather’s truck and entered Rasberry’s RV, where he shot Rasberry while he was sleeping. The boy confessed that he had no motive for the crime, as he had never met Rasberry before and did not know his name. The boy was visiting his grandfather, who lived in the same RV park as Rasberry, at the time of the murder.

Despite the boy’s detailed confession and the evidence linking him to the crime, he cannot be charged with Rasberry’s murder due to Texas law, which states that children under the age of 10 cannot be held responsible for criminal acts. Rasberry’s family is outraged that the boy will not face justice for the murder, especially considering how young he was at the time of the crime. The boy has since been placed in a psychiatric hospital for evaluation and treatment, as well as being booked on terroristic threats charges for the incident involving his classmate.

Rasberry’s brother expressed shock and disbelief at the revelation that a 7-year-old child had been responsible for his brother’s senseless murder. He questioned why the child was not under closer supervision and speculated that the boy knew exactly what he was doing when he committed the crime. Despite the tragic nature of the murder and the fact that the perpetrator will not be held accountable, the family is struggling to come to terms with the heartbreaking reality of the situation. The boy’s actions have raised concerns about the need for better supervision of young children and the availability of mental health resources for those in need.
