Ryan Routh, the man who is accused of attempting to assassinate former President Donald Trump in Florida, filed a motion last week asking for Judge Aileen Cannon to recuse herself from his classified documents case. The suspect was facing federal charges in Cannon’s court over his handling of sensitive materials seized from his Mar-a-Lago estate after leaving the White House. Cannon dismissed all charges after ruling that the chief prosecutor was illegally appointed. Routh claimed that Cannon could not be impartial as she was appointed by Trump and cited her decision to dismiss the case as evidence.

Routh’s attorneys argued that with the high stakes and public scrutiny surrounding the case, there should be no doubts about the appearance of impartiality by the presiding judge. Despite concerns, special counsel Jack Smith simply asked for the dismissal to be reversed, without seeking to have the case assigned to a different judge. The U.S. Department of Justice responded by stating that there was no legal basis to disqualify Cannon based on the president who appointed her. Routh alleged that Cannon could receive a promotion if Trump is re-elected as president, as reports have suggested she is on a list of potential picks for U.S. attorney general.

The Department of Justice maintained that there was no support for disqualifying Cannon based on the identity of the president who appointed her, and that Routh had provided no legal or factual basis for the court to disqualify itself. The trial for Routh is scheduled to begin on November 18, shortly after Election Day. He is facing federal charges related to firearm possession, as he was found with a firearm while being a former felon and possession of a firearm with an obliterated serial number. Routh did not fire any shots during the incident on September 15 but was arrested after a Secret Service agent spotted a rifle near where Trump was playing golf.

Despite the motion filed by Routh and concerns about impartiality, the Department of Justice has stood by Judge Cannon’s appointment and the decision to dismiss the charges against Trump. The case has drawn attention due to the high-profile nature of the accused, the former president, and the alleged assassination attempt. Routh’s accusations against Cannon have caused a public debate over the impartiality of judges in such cases involving influential figures. The outcome of the trial and the decision of the court regarding Judge Cannon’s involvement will be closely watched and could have implications for future cases involving public figures. The legal battle surrounding Routh’s case continues to generate interest and raise questions about the judicial system’s fairness in high-profile cases.
