The Diyarbakır Chief Public Prosecutor’s Office prepared an indictment against the defendant U.T., who is on bail, for the incident that occurred on January 8th, demanding a prison sentence of 8 months to 2 years for the crime of “simple injury”. The indictment was accepted by the 8th Criminal Court of First Instance.

The victim, Y.D, stated in the indictment that “I am a transportation driver. On the day of the incident, I went to the transportation warehouse. There was an argument between us because U.T. was moving slowly while unloading materials from the truck. U.T. attacked me with a stretch film pallet.”.

The defendant U.T. stated that he “attacked Y.D. with the stretch film pallet because he couldn’t bear the insults from him”.

According to the definitive physician report obtained after the incident, the victim was injured to a degree that can be resolved with simple medical intervention and there is no threat to his life. The indictment stated the following evaluations: “It is understood that the suspect injured the victim to a degree that can be resolved with simple medical intervention with the ‘stretch film pallet’ in his possession and committed the crime of ‘simple injury with a weapon’. The suspect is requested to be tried and punished according to the relevant article of the indictment.”

The “stretch film pallet” used in the incident was considered a weapon in the indictment, and a prison sentence of 8 months to 2 years for the crime of “simple injury” was demanded against the defendant U.T. The “stretch film pallet” considered a weapon was also taken into judicial custody.

The 6th article of the Turkish Penal Code containing the “definitions” states in sub-section f that “The term weapon refers to anything else that is suitable for use in attack and defense, even if it is not made for attack and defense purposes.”
