New York Republican Rep. Stefanik suggested that Merchan, a Democrat Party donor, may not have been randomly selected for these cases, but intentionally assigned to increase the chances of convictions against prominent Republicans, including Donald Trump and Steve Bannon. She has called on the New York State Commission on Judicial Conduct and the Inspector General of the New York State Unified Court System to investigate whether the required random selection process was followed in assigning these cases to Merchan, and if any rules were violated, to subject the responsible parties to appropriate discipline.

Stefanik also filed an ethics complaint against Merchan for an alleged conflict of interest related to his daughter’s work with Democrat politicians and political action committees. Merchan’s daughter serves as the president of a digital marketing agency that has represented clients such as Rep. Adam Schiff. Stefanik believes that Merchan’s ties to Democratic figures and his daughter’s financial gain through political consulting raise concerns about his impartiality in overseeing cases involving Republicans. President Trump has also criticized Merchan, calling him a “conflicted” judge and questioning his ability to preside over the NY v. Trump trial fairly. Trump has suggested that Merchan should recuse himself from the case, citing his daughter’s political affiliations.

In response to these concerns, Merchan has been placed under a gag order that prohibits him from publicly speaking about witnesses or making remarks about court staff, the DA staff, or their family members. Despite the gag order, Trump has continued to refer to Merchan as “conflicted” and “corrupt,” without providing specific details about the alleged corruption. Trump has argued that the case against him should be dropped and has called on the appellate court to intervene. He believes that dismissing the case would help Merchan regain respect and restore fairness to the legal proceedings.
