A South Korean court has sentenced the former police chief of a district in Seoul to three years in prison for his role in a deadly Halloween crowd crush that occurred in 2022. The former chief, Lee Im-jae, was found guilty of failing to prepare for the mass gathering and creating the conditions that led to the tragedy. Two other former police officials received sentences of two years and one year, respectively, with the latter being suspended for two years. The court described the incident as a “man-made disaster” that could have been prevented or mitigated if the accused had fulfilled their duties.

The Halloween crowd crush in Seoul’s Itaewon nightlife district resulted in the deaths of 159 people, shocking the nation, which was still grappling with the aftermath of the 2014 sinking of the Sewol ferry. The court’s ruling emphasized that the senior police officials should have foreseen the dangers of the gathering and taken appropriate measures to prevent such a tragedy from occurring. While the former police chief’s lawyer argued that it was unreasonable to expect his client to have prepared for an unforeseeable event, prosecutors had sought more severe penalties, including seven-year jail terms for some of the accused.

In addition to the former police officials, the court also acquitted the Yongsan district office chief, Park Hee-young, and three other district officials of failing to respond adequately to the crowd crush. The ruling stated that they were not directly responsible for crowd control and, therefore, should not be held accountable for the disaster. However, during a news conference prior to the ruling, relatives of the victims had demanded that both Lee and Park be held responsible for their roles in the incident. However, previous attempts to impeach the minister were unsuccessful, with the constitutional court ruling against the parliamentary vote last year. In response to the incident, parliament passed a bill earlier this year to launch a fresh investigation into the Halloween crush, supported by both ruling and opposition parties.
