Kennedy has faced legal challenges related to his social media statements, including a case currently pending in a lower court regarding the Biden administration’s interactions with social media companies about disinformation.

As part of his campaign focus on freedom of speech, Kennedy testified before a House Judiciary subcommittee on the weaponization of federal agencies. He criticized Biden for allegedly using federal agencies to censor political opponents, claiming that both Biden and Trump are unsuitable for reelection but chose Biden as a bigger threat due to the perceived weaponization of federal agencies against opponents.

Although Kennedy acknowledged Trump’s attempts to overturn the 2020 election results as a threat to democracy, he believed Biden was a greater threat due to the importance of protecting the First Amendment. The Democratic National Committee dismissed Kennedy’s comparison, stating that there is no parallel between Biden and Trump’s actions, highlighting the Capitol insurrection incited by Trump.

Kennedy expressed his belief that doubting election integrity should not lead to vilification of individuals and stressed the need for bipartisan efforts to improve the election system. He referred to past disputed elections, such as the 2000 and 2004 presidential elections, to underscore his concerns about election credibility. Despite his critical views on election processes, Kennedy emphasized that voters with different opinions should not face persecution for their beliefs.
