Democrats are celebrating Marilyn Lands’ victory in an Alabama state House race as a significant win that could impact the 2024 election. Lands, a professional counselor, defeated Republican Madison City Council member Teddy Powell by 26 points in a special election, flipping the Huntsville-area seat to Democrats’ control. Lands made her support for IVF access a key campaign issue, calling for the repeal of Alabama’s restrictive abortion ban and advocating for full access to in vitro fertilization.

Biden campaign manager Julie Chavez Rodriguez described Lands’ win as a warning sign for former President Donald Trump, attributing it to the controversial February ruling by the Alabama Supreme Court that restricts the use of IVF. Democrats believe that blaming the GOP for the IVF ruling, as the latest battleground in the reproductive rights debate, will be an effective strategy in the upcoming elections. They aim to capitalize on polls showing support for abortion rights and IVF access among the majority of Americans, positioning themselves against Trump and vulnerable Republicans.

Republicans are now trying to develop a clear messaging strategy around IVF, seeking to separate the issue from abortion after facing criticism for their confusing rhetoric on abortion restrictions. Trump, like many Republicans, has expressed support for IVF access while also advocating for limitations on abortion. He recently suggested he might back a 15-week federal abortion ban and called on the Alabama legislature to find a solution in response to the IVF ruling. Democrats argue that these conflicting stances on reproductive rights cannot coexist and are using the issue to target Republicans in the upcoming elections.

The Alabama Supreme Court’s ruling in February deemed embryos used in IVF as children protected under the state’s wrongful death law. This decision raised concerns about restricting the IVF process, as it could prevent patients from freezing embryos, which are often discarded if not used. Some clinics paused IVF procedures following the ruling, but resumed services after the state legislature passed a law protecting patients and caregivers. Democrats have seized on the ruling to criticize Republicans for supporting the overturning of Roe v. Wade, claiming that it empowered states to determine when life begins.

The National Republican Senatorial Committee issued a warning to candidates about the potential for Democrats to exploit the IVF issue for electoral gain. The committee advised Republicans to clearly state their support for IVF, oppose restrictions on the procedure, and campaign on increasing access to fertility-related procedures and services. Polling conducted by Republican consultant Kellyanne Conway’s firm found that a majority of respondents support expanding access to fertility treatments, indicating that this issue is crucial for both parties in the upcoming elections. The outcome of Lands’ victory and the focus on IVF access suggest that reproductive rights will be a key battleground in the 2024 election.
