Academician living in Aydın won a lawsuit against a company for 60 lira internet fee that he claimed was taken from him in violation of the contract.
Associate Professor Dr. Ali Emre Dingin, a faculty member at the Faculty of Communication at Adnan Menderes University (ADU) in Aydın, became an internet subscriber to a company for an annual commitment and a monthly fee of 99.90 lira.
After receiving a negative response from the consumer arbitration board, Dingin took the matter to court.
According to Dingin’s claim, the company issued an excess invoice of 60.37 lira above the price notified to him after the first month of the contract. Wanting to terminate his subscription, Dingin sent a letter of formal notice to the company through the website and in writing via the notary. With no response from the company, the academician brought the matter to the Efeler Consumer Arbitration Council.
Dingin demanded the termination of his subscription, the refund of the extra money he paid, and the necessary notary expenses for the formal notice.
After evaluating the application, the council responded negatively, citing that there was an execution process against Dingin by the company. Dingin then took the matter to the 4th Civil Court of First Instance in Aydın.
The court, accepting his objection, ruled in favor of Dingin, stating that it was not possible to make a new price change in accordance with the contract terms.
As a result of the decision, the cancellation of the contract requested by the applicant was carried out and 60 lira along with the notary expenses were refunded.
Dingin stated that he initiated the subscription cancellation process due to the increasing amount notified to him for internet usage every month, but since he could not achieve a result, he pursued his rights through legal channels.
Dingin emphasized the importance of reading subscription contracts, stating that there are clauses in contracts that do not allow termination of subscriptions without paying a certain amount. He advised individuals who believe they have made an unfair payment or received a high invoice like him to seek their rights through legal channels. He concluded by saying he wanted to set an example for consumers by winning the lawsuit for the refund of the excess fee he paid and all the legal fees incurred.
