Former FBI Deputy Director Andrew McCabe has suggested that Supreme Court Justice Clarence Thomas could potentially face a federal investigation over undisclosed gifts that he accepted from Republican donors. This comes after reports surfaced that Thomas failed to disclose luxury travel expenses and other gifts from wealthy friends, including GOP donor Harlan Crow. Democratic Senators Sheldon Whitehouse and Ron Wyden have called for an ethics investigation into Thomas following these allegations, specifically citing a $267,000 loan that the justice used to purchase a luxury motor coach in 1999.

McCabe discussed the potential ways in which the federal government could investigate Thomas on a podcast, including the FBI opening a full field investigation if there is information suggesting a federal crime has been committed. Whitehouse and Wyden’s letter to U.S. Attorney General Merrick Garland raised concerns about possible tax violations related to the luxury motor coach loan, as Thomas reportedly never repaid the loan, potentially leading to questions about whether he disclosed the apparent forgiveness of the loan on his tax returns. McCabe explained that the IRS would have jurisdiction over such accusations and that obtaining tax records for a criminal investigation would require a court order.

Despite the calls for an investigation, legal experts have noted that it is unlikely for Garland to agree to open an investigation into Thomas. Fordham Law School professor Bruce Green stated that the Democrats may have a strong case for opening a criminal investigation, but it would be risky for Garland to take action that could undermine public respect for the Department of Justice. Indiana University’s Maure School of Law professor Charles Gardner Geyh also mentioned that the situation is complicated by both legitimate reasons to investigate Thomas and political considerations.
