Senate Majority Whip Dick Durbin and Sen. Sheldon Whitehouse have requested a meeting with Chief Justice John Roberts amidst reports about flags flown at the Capitol building on Jan. 6, 2021 also being displayed at Justice Samuel Alito’s homes. The senators have once again called for the Supreme Court to adopt an enforceable code of conduct for justices, citing concerns about Alito’s impartiality in cases related to Trump and the Capitol riot. The Supreme Court is currently set to rule on important cases related to Jan. 6, including Trump’s immunity claim and an appeal for a man prosecuted for his actions at the Capitol.

Following reports about Alito flying an upside-down American flag at his home in Virginia in January 2021, Durbin initially expressed concerns but did not plan to hold an inquiry on the matter. Another report revealed that an “Appeal to Heaven” flag, also associated with some Jan. 6 protesters, was flown at the Alitos’ vacation home in New Jersey. These revelations have added to the controversies surrounding the ethical standards of the court, with calls for justices to recuse themselves from certain cases. Justice Clarence Thomas and his wife, Ginni Thomas, have also faced scrutiny for their involvement in Trump’s election efforts.

Durbin and Whitehouse’s letter to Chief Justice Roberts also alludes to Justice Thomas, suggesting that his participation in cases related to the Capitol attack and election overturning plot could be grounds for recusal due to his wife’s involvement.
