Despite this legal notice, the sports bar decided to poke fun at the situation and celebrate National Cheeseburger Day on September 18 by posting a marked up and redacted version of the letter on Facebook with the caption “Cease & Desist what you’re doing right now, you’ve got to see this.” The restaurant humorously announced that they had been “officially recognized by Big Burger” and even changed the names of their menu items to Secret Menu Fries and Burger Burger.

Restaurant owner Shane Gerde expressed his flattery at being recognized by In-N-Out and acknowledged that his menu items were inspired by the popular fast-food items, but with a slight twist that makes them unique. He mentioned that the dishes were meant to give guests an idea of what they were ordering without needing a detailed description and that they were a unique take on Southern California classics. Gerde emphasized that Fairplay Sports Bar provided a neighborhood spot where patrons could enjoy these dishes in a different atmosphere than a traditional fast-food chain.

Despite the legal situation, Gerde maintained a positive attitude and expressed no animosity towards In-N-Out Burger.
