David Pagniano, a 62-year-old man from Arizona, has been sentenced to life in prison without the possibility of parole for the 2017 death of his wife, Sandra Pagniano. Sandra was buried alive in a hand-dug grave near their home while their children slept. Seven years after the murder, David decided to plead guilty before his trial was scheduled to start and allowed a judge to determine his sentence without a plea agreement. In addition to the life sentence, he was also sentenced to a 16 ½-year prison term for kidnapping, forgery, and fraud.

County Attorney Dennis McGrane stated that his office had pursued the death penalty due to the horrific circumstances surrounding Sandra Pagniano’s abduction and murder. Sandra was kidnapped from her home while her children slept nearby, bound in packing tape, driven to a remote location, and buried alive. Evidence revealed that she struggled vigorously while in the grave and was likely conscious for up to five minutes after being buried. Sandra had disappeared while in the process of divorcing David Pagniano in May 2017. Despite being separated, they were still living in the same home with their two young daughters.

Sandra Pagniano’s body was found bound and gagged in packing tape inside a grave in a rural area north of Prescott. The county medical examiner confirmed that she had been buried alive. Cellphone evidence showed that David Pagniano was in the gravesite area days before his wife went missing and the night of the kidnapping. Two notes found in the divorce case after Sandra’s disappearance, purportedly written by her, stated that she was leaving David and giving him her assets and custody of their children. However, a forensic examination revealed that the notes were written by David.

After Sandra’s body was discovered, buried in a remote area 10 miles northwest of their home near Prescott, David Pagniano was indicted by a grand jury on a charge of first-degree murder. McGrane expressed hope that the life sentence would bring closure to the victim’s family.
