Amal Clooney and other legal experts recommended that the chief prosecutor of the International Criminal Court seek arrest warrants for Israeli Prime Minister Benjamin Netanyahu and leaders of Hamas for alleged war crimes. In a letter posted on the Clooney Foundation for Justice website, Clooney explained that the panel of experts unanimously agreed that actions taken by both Israeli leaders and Hamas during the seven-month war in Gaza amounted to war crimes. The panel, comprised of experts in international humanitarian law and international criminal law, recommended seeking the warrants to protect civilian lives.

The panel’s recommendation, published in an op-ed in the Financial Times, was based on the principles of the rule of law and the protection of civilians in war. The expert panel included former judges at criminal tribunals at The Hague, where the ICC is based. International Criminal Court chief prosecutor Karim Khan announced his intention to seek arrest warrants for Netanyahu, Israeli Defense Minister Yoav Gallant, and three Hamas leaders. The judges at the ICC will ultimately decide whether to issue the arrest warrants and allow the case to proceed, a process that typically takes two months.

Netanyahu and Israeli leaders condemned the move, calling it disgraceful and antisemitic. U.S. President Joe Biden also supported Israel’s right to defend itself against Hamas and criticized the prosecutor’s actions. However, Israel is not a member of the ICC, so even if the arrest warrants are issued, Israeli leaders do not face immediate prosecution. The threat of arrest could still make it difficult for Netanyahu and Gallant to travel abroad. Hamas is already considered an international terrorist group by the West, further complicating the situation.
